Notice will be served by our Lawyers on your tenant, depending on which route has been decided it might be under both section 8 and 21, or NTQ notices. This initial stage in lots of cases is often sufficient enough for the tenant to settle the arrears, or vacate the property by the deadline given.

If a tenant is still refusing to leave the property, even after a court order then it will be necessary to evict them via a high court enforcement agent, or a county court bailiff.

This is generally a much faster way of regaining possession. Landlords can find themselves stuck at stalemate when waiting for county court bailiffs, with further rent arrears building up. The High Court route can reduce time frames considerably, and to do so our Lawyers will make an application to the court for leave to transfer your case to the High Court at the point of obtaining the possession order. A Writ of possession to take the property back will be applied for by us upon issue of the possession order. This usually means the eviction can take place within 7 -10 days of the date given to vacate.

If an immediate eviction is not necessary then our Lawyers can apply for a warrant, from the County Court. The court bailiffs will then execute the warrant and obtain vacant possession of the property. Due to the high case load in many courts this procedure can often take many weeks or months Please note: If this process is selected then it will be required for the landlord or their agent to attend the eviction and sign the warrant.
